Terms of Service

These Terms govern the conditions of use of SUDA, a voice-based English and Korean conversation-practice application provided by Preek AI inc. (the “Company”), the official website sudatalk.app, and related features (collectively, the “Service”), together with the rights and obligations of the Company and users. By using the Service or completing the consent process, you are deemed to have agreed to these Terms.
① Definitions
- “Service” refers to the SUDA app, official website, legal notice pages, and related features provided by the Company.
- “User” refers to a person who uses the Service in accordance with these Terms.
- “Account” refers to a user-identification unit created either in anonymous-use mode or through social login.
- “Subscription” refers to the right to use paid features for a certain period.
- “User Content” refers to conversations, transcripts, settings, learning records, and other information that a user inputs, speaks, sends, or generates while using the Service.
② Account and Age
- The Service is intended for users who meet the applicable age requirement (14 years of age or older).
- The Service may use an anonymous account state to launch the app and provide certain free features. Some features, such as adding friends, scheduled calls, and paid calls, may require social login and an active subscription.
- Users may create or link an account through social login (Google, Apple, Kakao). Provider availability may vary depending on app version, platform, region, and configuration.
- Users are responsible for managing their own account and login information, and do not permit others to use their account.
- Users who do not meet the age requirement may be restricted from using the Service.
③ The Service
- The Service provides conversation practice through voice calls with AI or friends, real-time captions and corrections, pronunciation assessment, post-call review, vocabulary features, friend features, group invitations, scheduled calls, and push notifications.
- Some learning pages and trial features determined by the Company may be provided for free. The Company may change the free scope, call duration, usage count, and paid-feature scope depending on service operations.
- Some conversation partners are provided automatically by AI, and the results of calls, captions, corrections, pronunciation assessment, and learning summaries are generated automatically.
- Calls with friends or calls joined by an AI coach may use external communication and voice-processing services for real-time call connection, captions, notifications, and room management.
- Learning outcomes may vary depending on each user’s frequency and manner of use.
- Some features may be limited or unavailable depending on device type, operating system, network conditions, app-store policies, subscription status, region, and failures or changes in external services.
④ Notice Regarding AI and Voice Features
- Responses, corrections, and assessments generated by AI may be inaccurate or differ from the user’s intent, and are provided for learning reference.
- The Service is intended for language learning and is not intended to provide professional advice such as medical, legal, financial, psychological, or emergency advice, nor to provide an essential communication channel.
- During calls, microphone-input voice may be sent to external voice, AI, and communication services for real-time transcription, dialogue generation, speech synthesis, pronunciation assessment, and call connection. Calls are not provided as end-to-end encrypted calls.
- The Company does not include original voice files among stored Service items, but call content may be stored as text transcripts, reports, review items, and learning-support data.
- When calling friends or other users, users must respect the rights and privacy of the other party and must not record, store, publish, or distribute call content, transcripts, voice, screens, or personal information without the other party’s consent.
- Details regarding voice data and personal information are handled in accordance with the Privacy Policy.
⑤ User Obligations and Prohibited Conduct
Users do not engage in the following conduct.
- Conduct that violates laws or these Terms, or that infringes the rights of others
- Impersonating others or registering false information
- Interfering with the normal operation of the Service, or improperly accessing or using it through automated means
- Circumventing or abusing limits related to subscriptions, free trials, call volume, notifications, invitations, or friend features
- Reverse-engineering, copying, or distributing the Service without authorization, or using it commercially without permission
- Recording, capturing, posting, or distributing call content or transcripts without the other party’s consent, or collecting or disclosing another person’s personal information without authorization
- Generating or distributing hateful, unlawful, harmful, harassing, sexually exploitative, or violence-promoting content, or other conduct contrary to commonly accepted social norms
⑥ Subscription and Payment
- Paid subscriptions are provided through in-app purchase on the Apple App Store or Google Play, and a free trial may apply.
- The actual amount charged, currency, taxes, and whether a trial applies follow what is shown on the store’s payment screen before purchase.
- A subscription may renew until cancelled, in accordance with the store’s display and settings. Cancellation can be done through subscription management in your Apple ID or Google Play.
- Deleting the app, logging out, or deleting an account may not automatically cancel a store subscription. Subscription cancellation must be completed through the relevant app store’s subscription-management process.
- Refunds are processed according to the refund policy and review of the store where the purchase was made (App Store, Google Play). The Company is not an intermediary for refunds, and refund requests should be made through the relevant store.
- Where permitted by applicable law and app-store policies, the Company may limit feature access or request additional verification in cases of fraudulent use, excessive automated use, or risks to security, cost control, or service stability.
- Users residing in Japan are asked to also refer to the Notation Based on the Act on Specified Commercial Transactions for transaction terms.
⑦ Intellectual Property
- Rights in the Service and its components (software, design, characters, text, voice, etc.) belong to the Company or the rightful rights holders.
- Rights in User Content belong to the user, and the user permits the Company to use such content to the extent necessary to provide and operate the Service, maintain security, diagnose errors, improve quality, and comply with legal obligations.
- AI responses, corrections, translations, pronunciation assessments, summaries, suggested expressions, and other automatically generated results are provided for learning reference, and users use them at their own responsibility.
⑧ Disclaimer and Limitation of Liability
- The Service is provided on an as-is basis as currently available, and the use of some features may be limited depending on network conditions, devices, external services, user settings, and similar factors.
- The Company does not guarantee that the Service will always be uninterrupted, or that AI responses, transcripts, translations, pronunciation assessments, notifications, or call-connection results will always be accurate or meet the user’s expectations.
- Users are responsible for disputes arising from calls between users, friend requests, group invitations, and information that users provide during calls.
- To the extent permitted by applicable law, the Company limits its liability for indirect or incidental damages that arise despite the exercise of ordinary care. This provision does not limit liability that cannot be limited under applicable law.
⑨ Changes to and Suspension of the Service
The Company may change the content of the Service or suspend all or part of the Service as needed for operational or technical reasons. If external AI, voice, communication, push, payment, or authentication services fail, change, or become restricted, provision of the Service may be delayed or limited. For significant changes, the Company provides notice by an appropriate method.
⑩ Termination of the Agreement and Account Deletion
Users may request account deletion through the in-app settings feature. When an account is deleted, the handling of personal information follows the retention and disposal standards of the Privacy Policy. Account deletion is an in-app data deletion process and does not replace cancellation of an app-store subscription. The Company may restrict use or terminate the service agreement if a user violates these Terms or applicable law, or creates risks to service stability or security.
⑪ Governing Law and Disputes
These Terms are governed by the laws of the Republic of Korea. Where mandatory consumer-protection rules apply in the user’s place of residence, those rules may take precedence. Disputes are resolved first through consultation, and where consultation is not reached, the procedures under applicable law are followed.
⑫ Changes to the Terms and Inquiries
The Company may change these Terms, and when it does, it gives notice within the Service, on the official website, or by a method determined by the Company. If you continue to use the Service after the changed Terms take effect, you are deemed to have agreed to the changes.
